Boehner’s lawyer uses recent gay rights successes to argue in favor of discriminating against gays

But attorneys representing the House's Bipartisan Legal Advisory Group counter that DOMA is subject to a lower level of court scrutiny because gays and lesbians don't meet the legal criteria for groups who receive heightened protection from discrimination. Under that lower standard, DOMA is constitutional, they argue.
They go on to cite the lifting of DADT and our marriage victory in NY as proof that we're not politically powerless.

So, what Boehner is really arguing is that he has the right to discriminate against gays because we've recently begun to win the right to not be discriminated against. So the only way to win our rights, according to Boehner, is to either lose them or not fight for them at all.

The man is priceless, with his precious little perma-tan and his forever boyish looking deputy.
